    Thanks Coupon Mad, some questions
    a) should the 'Template appeal for BPA members' letter be sent now or later into the response period?
    b) i note the template makes no reference to request of the PPC evidence (as the keeper was not the driver at the time, should this be requested?
    c) the IPC templates contain alot more info, do i request the same information as part of the POPLA process?

    thanks in advance, the brain has gone into research overdrive and reading the schedules of the POFA has disturbed my brain a little.

    I am currently fighting Gemini re a ticket at the Copper Box. I think you may also be covered by Olympic Park Byelaws Quoting, “Please note that parking at either site is only for visitors to the Copper Box Arena or London Aquatics Centre - if you are not visiting either of these venues, this will result in a parking fine of £35.”

    and tiny url has not worked again... i tried... here is the copy n paste of their letter response....

    We refer to your appeal regarding the above parking charge notice. We have investigated your appeal
    and have considered the points that were raised within your letter.
    Your vehicle was seen by our parking operative on 23/12/2015 at the above location for the
    contravention of "Parking in No Parking Area”.

    We have noted your comments regarding insufficient and unclear signage however; we can confirm
    that there is a clear signage advising motorists that all vehicles must be parked within allocated
    parking bays only. On the date of contravention, your vehicle was parked on public footpath which is
    in breach of the terms and conditions therefore our Enforcement Officer issued a PCN and we are
    satisfied that it was issued correctly. Unfortunately, we are unable to take your mitigating comments
    into account.

    You claim that we have not made it clear that there is opportunity to appeal however; on the back of
    the PCN that was attached onto your vehicle is a clear explanation of the appeal procedure. The
    same information is on the back of the reminder letter that was sent to you on 27/01/2016.
    The above location is a private property and is managed by Gemini Parking Solutions London Ltd on
    behalf of the land owner. When parking on private land, a motorist freely enters into an agreement to
    abide by the conditions of parking in return for permission to park. It is the motorist’s responsibility to
    ensure that he or she abides by any clearly displayed conditions of parking.
    Gemini Parking Solutions fully complies with the guidelines set by that of the British Parking
    Association who are the regulating body for the parking industry. You were parked outside of the set
    terms and conditions of the site and as a result we have rejected your appeal as your representations
    did not make sufficient grounds.

    The payment for £100 is now due as you have exceeded the 14 day period. Failure to pay the amount
    will result in further costs being incurred and may also result in Gemini Parking Solutions Ltd
    Instructing a Debt Collection agency to collect any sum due.

    Standard rejection letter, nothing special just computer says 'no' junk except that they should have given you a POPLA code.

    So have a look at recent POPLA appeals on the first ten pages of this forum, you should find several similar ones. We KNOW there have been POPLA appeals about being parked without authority, not Gemini ones but other small firms, all similar.

    You have ages, 28 days to work on it so let's see your draft and don't forget 'no keeper liability' which - astonishingly - gets missed off by so many Newbies who don't get that is the entire point of why they've appealed as Keeper.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hi C-M, they did give me a POPLA code in the body of the email, this letter was an attachment to an appeals response email (which they never even disclosed was part of the appeal process or that there was one, instead they just demanded payment).

    If it was by their own definition "a public footpath" surely they have no claim to enforce any made up PPC rules to cover it.
