Default CCJ from CEL set aside - what next?
Comments

Getting a ccj set aside and then paying it is just an abuse of the system and will just result in set asides being made harder in the future.0

it is the behaviour of people like you that keep ppc scumbags in business. I hope the ccj stays on your credit report, I hope this whole incident costs you a lot more money than it has already. maybe then you will start to learn.georgealice wrote: »I have no desire to defend the case, regardless of whether I have a good chance or not.0 -
Abuse of process, or of the system such as not turning up after getting a set aside does not go down to well with the courts, and thats putting it mildly.
Abuse os the system is one of the things getting the private parking companies nto troubleFrom the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0 -
Surely the two points that needed to be addressed to get the set aside were:
1. A good reason for not responding to the original claim
2. A reasonable prospect of successfully defending the original claim
So, essentially, whatever you put for #2 was a bluff??Je Suis Cecil.0 -

Maybe I'm just a scandalously weak person, although I hope not. Sitting opposite the judge in that court room terrified me, I can't deny that, and I would give a lot not to have to do it again.
Do I have to wait for them to submit the claim again so that I can dispute it? I dont even know where to start! I was expecting the court to send me something to confirm the CCJ had been set aside, and take it from there but maybe they aren't sending anything and I'm waiting for nothing.
I don't think you are weak at all. Have you heard anything? CEL defence recently written here:

Hopefully you have now heard more so I thiought you would need to see an example CEL defence.

You have nothing to lose, and put in a decent defence and CEL probably won't even turn up.
So listen to the advice on here, do some reading-up and prepare a defence. I know it seems like a mountain, but believe me, once you've put a little work in and understand what's going on, it really isn't.
If you show you're putting in a bit of work in then you will get plenty of help on here.
I know the court process appears to scare you, but think of this as a life-learning experience. You never know when you might need it again.0
