Quick banking question.

Hi there

I have been speaking to someone recently who was lending their bank card to a close friend to help them out while they were unable to get out. This so called friend was taking out a lot more money that the person agreed to. Can I just ask does this lie with the cardholder as their stupid fault for giving a friend access to their money or is this a criminal offence.

  • I would have thought they were both at fault. Do they not ask for a receipt from the machine? Have you said nothing? Has this not been reported? Why are they still allowing this person to use their card?

    It's a criminal offence as they have stolen money, but how would you prove it? They freely gave their card and PIN number (which is enough for the bank to close the account for breaking t&c's and misuse) to the third party.
  • As above, both at fault, but very difficult to prove a) how much was asked for, and b) that he didn't receive all the money that was withdrawn.

    I am going to disagree with the above posters , the blame is solely at the feet of the person who took the money. It is theft and a criminal offence. The card holder may have been fool hardy and in breach of the accounts T & C`s but has broken no laws, its certainly not illegal to give your bank card to a third party and in such ,in the eyes of the law has done nothing wrong.

    The bank probably won't be that interested, as your friend would have broken the T&Cs when he lent the card and gave out his PIN.

    However if your friend had lent his car instead with instructions you can go from Southampton to Portsmouth and back, and the friend took the car and drove to Inverness, then the friend has acted against the parameters that were set. So in this case, the person with the card has also acted outside of the set parameters and has stolen the money.

    It's a police matter. It will come down to "I told him he could take out £50 but he took out £800" and the other party denying it.

    Judge Rinder would have a heyday telling the card holder that they were utterly stupid, not only for lending their card to someone else, but also for not having any written agreement for this unusual arrangement. It will be word against word and therefore the card holder should just put it down to experience and be more careful in future when choosing their friends.

    The bank won't be interest as soon as you investigate a fraudulent transaction they ask if you have given anyone else your card or PIN number.

    When PIN numbers are sent to the cardholder it says do not disclose to anyone else.

    As they Willingly gave them the card and PIN number nothing can be done as there is no proof what was asked to be withdrawn or what was given over.

    A lesson learnt I think.
