Livingsocial cancelled my order 2 days before xmas

Hope someone can help?
Ordered some beats headphones through livingsocial 2nd December with confirmation email and payment taken for son's xmas present. Got concerned that status wasn't changing to shipped. after 3 attempts of 30 minute calls, finally got through to someone a week ago who said all fine, already shipped and will be with you on the 22nd December. Today (22nd) I received an email saying my order cannot be fulfilled due to a discrepancy with stock and will refund me. with 2 days until Xmas everywhere has sold out or are charging more than double the amount.
Do I have any comeback? I would rather the present late than not at all! If they had been honest with me when I called I could have looked for an alternative solution.

If you'd prefer late, then re-order (from elsewhere if you prefer) on the 26th when the price will undoubtedly be cheaper.
As it is, I fully expect that their terms will state that the contract will be concluded on dispatch. Probably not the answer you were hoping for, but they are entitled to refund.
If you can prove that they said it had been dispatched, then you could fight them, but it would be fruitless as you still wouldn't get one before ChristmasOne important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0 -

Generally 6, but there are often 7...
Prior Preparation & Planning Prevent (Pi**) Poor Performance.
I suspect the poster was referring to the fact you ordered comparatively close to Xmas??
You know the Beats stuff is one of the most faked ranges of products worldwide, yes? (and poorly performing, over-priced, style-over-substance, crap anyway - in my opinion)
