Go round to the seller's address as listed on the V5C. Or was it a dodgy back street trader selling a 'part ex to clear' in a random car park?

If your neighbour ends up spending £800 in total for a good running Primera, and gets a while out of it, he's done well! You've no comeback against a private seller unless they've basically answered your questions falsely.0

I'm just paraphrasing the rules. You've given one example that goes against those rules, and not a lot of details.0 -

The OP was kind enough to update with the final result
The car had been sold as a private sale with a slightly awkward gearshift fully declared on test drive.
I think it was when selecting reverse but can't remember the specifics.
In any case I personally thought it was declared and he is all good.
But no the judge went against what I considered to be the law as far as selling a used car privately goes, buyer beware.
Even with the declared fault he lost.
One reason why I personally believe people prefer to sell cars using WBAC and other similar companies
Not because they might be able to get a better deal on their next car but to avoid those kind of buyers that want a car for next to nothing, then come back 3 months later saying the car is no good and wanting all the money back.
I used to see these kind of people regularly when I ran a garage. They would do it to have free car for a week or so.
Even had one that cut the boot on the steering rack and wanted to use that as a reason to get his money back!
The world is sadly filled with many !!!!!! and the dishonest.
Nothing you can do about it as they tend to have knowledge of all the ins and out of law better than a solicitor.0 -
Which is why most car dealers are awkward when it comes to refunds... peoples expectations are unrealistic and their demands are excessive.0

Yep. I sold 5000 cars in my career. The classic was a punter wanting a refund after a week...except they had swapped the decent tyres it came with for 4 nearly bald ones.
Luckily the MOT certificate I had had done gave the tread depths AND make of tyre at the time of MOT 2 weeks earlier.
I told him where to go and eventually threatened to report him for fraud. So he went where I told him to go!0
