    It makes sense, but doesn't seem "fair" at all. Obviously I'm going to say that as I'm the injuried party. But I hope you can see my point.

    What if some 20 year old hit us instead and just claimed of a "blackout". Wouldn't stand up in a court of law. Surely. Otherwise everyone would be claiming it.

    Not many would be quick thinking enough - but what would they gain anyway? (other than their licence being revoked/suspended on medical grounds).

    True. If it makes a difference third party swerved & hit brake pedal, then hit us. Was also conscious at the scene.

    Instruct your own solicitors to pursue a claim for injury and uninsured losses. The third party won't go to trial if their policyholder is dead.
