It makes sense, but doesn't seem "fair" at all. Obviously I'm going to say that as I'm the injuried party. But I hope you can see my point.
What if some 20 year old hit us instead and just claimed of a "blackout". Wouldn't stand up in a court of law. Surely. Otherwise everyone would be claiming it.0 -

Instruct your own solicitors to pursue a claim for injury and uninsured losses. The third party won't go to trial if their policyholder is dead.0
