Car Insurance Claim Help!!!

Hi everyone,

I had taken out a new car insurance policy it has only been 2 months. I am the policy holder and my sister is the second driver. MY sister was in an accident. I called up the insurance company and reported it to them.

The problem is they asked me if I was still a student which I am not and currently unemployed furthermore, I had an accident 2 years ago which I did not disclose at the time of making the application (as it solved and not my fault). But when they asked me about it I told them I about the accident, and they said they would get their underwriters to double check it.

I am not sure what would happen now, because of my change of circumstance and also them being notified of a previous accident which I did not mention to them before

The only thing I can think of is my policy being cancelled

can someone please advice on what I should do?

Not a lot you can do till you hear from them. They have a number of options open to them which range from increasing your premium to cancelling it.

Read up in your policy about your responsibilities to inform them of material changes so you know what to do next time your circumstances change.

  • You have basically, obtained insurance fraudulently by making a false declaration.
The claim will be paid on a third party basis to the other party if you are liable as the road traffic act is in force.
Then it crosses in to contract law.

Without reading the contract we can not say if they can recover the costs from you, but it is often a standard clause.

The best outcome would be if they ask for an increased premium, snap at if they do.
Often its a 7 day legal notice of cancellation in the post and pursuit for costs of the claim.
Sorry if this sounds harsh but I doubt you were expecting people to say it will be OK.

When they asked you if you had been involved in any accidents or claims in the last (5?) years, why did you lie?

If they cancel your policy you will be liable for any costs and will have to declare the cancelled policy for life, meaning increased premiums for life.

If they feel generous they will need you to pay for the backdated increase in premium if you had been honest from the beginning.

  • The Consumer Insurance Act will give you legal protection if you unknowingly give incorrect or incomplete information to your insurer

I don't think he could claim he didn't know when its a specifically asked question
  • Unfortunately, non-disclosure of claims is entirely on you. The CIA has no relevance if you were asked a direct question (which you almost certainly were).

It all depends on the question asked - the wordings do vary. The OP answered no 'as it solved and not my fault'.
