Selling BP Shares via Capita = Nightmare

My husband has POA over an elderly relative. When we heard a few weeks ago that she had a terminal illness, we started to liquidate her assets. Every single company and organisation - building societies, insurance companies, other shares-companies, the Government ("granny bonds") responded quickly, recognising the POA and shunting through her money.

Every single one except BP / Capita.

I sold her BP shares online on November 13th.

They sent a form which we completed and returned, signed-for, on November 17th.

They wrote back on November 19th saying they did not recognise the fact that my husband has POA. I sent them the POA on November 25th, signed-for.

On 30th November they wrote telling us that they did not accept the POA, and returned it. This is the one which every other organisation had accepted instantly. In that letter they also said "the holding has been reduced to a nil balance and no monies are outstanding".

There is about £750 due from the sale of the shares.

On 3rd December they (BP) wrote again saying that "they have been contacted by Capita, who have confirmed that there is an outstanding payment owed to (name of recipient).

I contacted the solicitor who drew up the original POA. She said she would write them a Legal Letter to gee things up. Three weeks passed and in that period the elderly relative died. The POA is now invalid.

Today my husband phoned BP and Capita and was shunted around from one department to another. Finally they say, to our disbelief, that they issued a cheque on November 18th. They say they posted it to us on November 19th. Their computer says so, so it must be true.

This is unbelievable. They will NOT cancel the cheque and issue another one - despite revealing that their "cheque" has never been presented for payment - without a letter from my husband, and the death certificate, and an Administration Charge. We will not have the Death Certificate until new year because this lady did not die in the UK. They do not care about that, computer says no.

They did not send a cheque. If they had, it would have arrived weeks ago. They did not send a cheque because they were too busy arguing about the perfectly valid POA on exactly the same date. They are the absolutely worst company we have had to deal with at this very difficult time.

Any ideas?
