Park Direct evidence from a mobile device but no PCN served

Dear all,

Thank you in advance for reading this.. Yesterday I received a parking charge notice through the post. The alleged contravention was on the 10th December and the notice was served on the 15th.

I have read in some threads that a notice has to be served on the screen unless by those aprn, is it true? Also, the signage reads site monitored 24/7 by cctv but the evidence was produced by a mobile device (god knows who).

    Your starting point, to enable you to start to understand the issues involved here, is the NEWBIES FAQ sticky, located near the top of the forum thread list, one page back from here. Post #1 and #2 are all you need at this early stage.

    Please confirm the precise name of the PPC, 'Parkingdirect' is not one I recognise.

    A photo upload of the signage outside the school would also be really helpful to us in advising how to overcome this.
    To upload a photo/scan, you first need to host it on a free photo hosting site (Photobucket or Tinypic), copy the URL, paste it here, but change the http to hxxp (or remove it all together) and we'll do the conversion. Newbies can't directly upload photos/scans until they've got a few posts under their belt

    Was the car parked actually on the road named 'Elias Place'? Use Google maps with the post code from your last post to check out my reading of this.

    There are council parking signs all over that road and a private parking company cannot in their own right be issuing PCNs on a public highway. Please do check on Google maps - if it is as shown (look at the council parking signs there), then make a phone call to the council tomorrow to ask why a private company is issuing PCNs on the highway.

    Thanks for confirming it is 'Park (not Parking) Direct'. We do need absolute accuracy in the details given, as many parking companies have very similar names and/or acronyms.

    Park Direct are BPA operators, giving you access to POPLA and can be defeated there.

    elias Place is not Council controlled. If they are relying on evidence from a mobile 'phone they are flogging a dead horse.

  • It looks like it's an extension from thw building in which I believe belongs to the state. The car park is facing the road but the signage itself is on the wall of the building separating it from the car park, which is located at the back of the car park (not on the public highway).

    Thank you for your replies so far.

    Do I have grounds to appeal or should I just pay to avoid hassle? I really don't want to pay for this, unless O have to.

    By all means pay if even a modicum of hassle is anathema to you. Your life will be hassle free, but you may have a lot less wherewithal than others made of stronger stuff.

    Alternatively, you can grasp the nettle and make a stand. Read this

  • I am happy to appeal as long as I have grounds for it. I'm no expert hence why I'm a panicking a bit. Do you think I have grounds to appeal?

    Of course you have grounds for appeal. Posts #1 & 2 of the newbies sticky will start you on your journey. You have every prospect of killing this.

    You will learn lots through this process and hopefully won't get caught out again. And you'll be able to tell your friends about the spurious activities of the private parking skimdustry.
