Accused of being in a car accident obtaining CCTV

My OH has today had claim forms through from a 3rd party solicitors company stating that a few days ago he hit a car while in a petrol station.
At the time and date given he was in the petrol station and remembers the car in question as it was such a new 'posh' for want of a word car.
He did not hit the car in any way. Nor is there any damage to our car so getting these solicitors letter for damage to the car from the driver and as a compensation claim for injuries to the passenger has come out of the blue.
Can anyone please advise how we would be bale to get copies of the petrol stations CCTV? Would it be a subject to access request direct to the petrol station or to the petrol stations head office?
Really its the 3rd parties word against my other halves so the CCTV could make all the difference.
Oh course we shall be cooperative with our insurance but in no way did my partner hit the other car. Any advice would be most welcome thanks

    Don't know what you mean by being co-operative "without" insurance.

    But you do need to pass these "claim forms" (unanswered)on to your insurer immediately (make sure they know your side of the story) - and they should enquire into the possibility of the garage having any video and getting a copy.


    (If you get further correspondence over this you need to also pass it straight to your insurer unanswered)

    Sounds a bit strange to be honest.
    If he had hit a car and done a runner so to speak surely this would have involved the person calling the police and their insurance company.


    Cant understand where the 'Solicitor' comes in.


    Be careful, but do ring your insurance company up and ask for advice. If he is convinced he is guilty, let them deal with it and send a copy of the letter to them. Its what you pay them for.

    Some years ago, some so-and-sos egged my husband's new car (damaging the paint) ,while he was leaving a Tesco petrol station.


    They happily checked their footage, but though the culprits were on film, they were not in view when they did the damage.

    the papers we have had through today are vague to say the least. For example they give the 3rd parties solicitors details and the third parties address but not of the address of the petrol station. They are from a solicitors called CAMPS not an insurance company. They state that they got the details from the DVLA. One is a RTA2 form with the claimants details being 2020 Legal LTD and the driver has had no time off work but has whiplash and shoulder pain. Neither has he sought medical attention. They are claiming for the car damage through the insurance it is not likely to be a write off. Nor did they need a hire car. Not reported to the police. It also states that the claimant has undertaken a funding arrangement within the CPR rule on 16th December
    The second form has a different claimants name him being the passenger whom suffers from soft tissue damage and back pain with no medical attention or time off work.

    Whatever you get about this just send straight on (unanswered) to your insurer.


    If you get any telephone calls do not engage with them, but refer them to your insurer and end the call
  • When something vaguely similar happened to me a year or so ago, the first move (after a letter arriving out of the blue) was my insurer sending a photographer round to photograph my car.


    Mine had a happy ending, but it took some time. Hope you get the same.

    I work in a petrol station, you can request the petrol station to burn the incident onto a disc from the cameras, but legally they can only hand the cctv recordings to the police.

    CCTV is usually kept for about a week before it is deleted

I was wondering how he would stand as I used to work as a manager for one of the large supermarkets and we wouldn't just burn onto disk from our cameras. That would have to be done through head office security. Although as a manager I could view it but wouldn't be allowed for example to take non staff into the area it would be viewed in. Im guessing the next papers through will be from the third parties insurance themselves. The third party don't even live a mile away from us and i'm guessing are using a no win no fee solicitor as they dont have legal motor cover on their insurance policy.

    True, the station will not allow you to view the incident on cctv in the office, but providing you can give them enough details (time, date, make, model, colour and reg of your own vehicle) they should be able to find any camera shots with your car and willing to burn it onto a disc before it is automatically recorded over. ready to be collected by the authorities.

    Its very common for CCTV in a petrol station to be burnt off immediately should something happen, eg someone drives off without paying for fuel or shoplifting, if head office got involved the cctv would probably have been recorded over by the time they responded!
