concert tickets

ibought 6 tickets for THE CORRS at manchetser arena fom EVENTIM first upper tier block beside the stage row A due to 2 of the party not being able to stand up for long periods so they could enjoy the concert without having anyone standing in front of them.

Due to reasons only known to the promoters they have no closed the upper tier and now moved us to a lower lever a a block further away from the stage and now in row U

I have asked to cancel to tickets as they have broke the aggrement i had paid for but they insist i cant. i can however change tickets but this is the higher band and would mean i have to cancel current order and loose booking fees etc then pay for the dearer tickets plus the booking fees again.

I bought E-tickets as well yet now these new tickets are collect from box office only stoping me selling at least 2 of the tickets

Do i have any rights to enable me to force a cancelllation?

    Unless you made it clear that you were buying the tickets for that specific purpose then there is no breach of contract on their end. They have remedied the issue as best they can by moving you so you can still go to the event you paid for.

    We have I have asked to cancel the full order so the remaining 4 can book better/ more expensive tickets as what's remaining and better where we want

    That would all depend on whether OP had selected seats from a specific price band and then had been allocated seats randomly. Or whether they had booked specific seats.

    I think you're perhaps getting a little confused between fit for purpose and matching its description.

    If he booked specific seats and he is not now getting those seats, that is a breach of contract as its a change of subject matter - a core term. Goods and services must correspond to their description. Yes suppliers can have a clause stating they may substitute goods/services, but the consumer still has the choice to accept or reject that variation - especially if it means they could end up with something different from what they agreed to buy. If it was due to circumstances outside of the suppliers control, then their liability can end with return of prepayments. If it was within their control, then they can also be liable for damages.

    Yes we picked the tickets where we wanted to be as you can with eventim on their interactive seatplan. The whole idea was to pick seats in the upper tier as close to the stage as possible so we were guaranteed not to have anyone stand up in front of 2 of the party.

    Now we have been moved a block further away from the stage and row U in tickets in the same price so there's no way everybody is going to stay seated for the gig

    So far im banging my head against a brick wall with them but they are adamant i will loose booking fees and want to me to rebook again for 4 again paying booking fees even though i booked online and will be doing so again

    Another thing is a selected E-tickets to print at home yet these have to be collected from box office again stopping me from keeping the order but selling the now 2 spare tickets:mad:

    Being honest there's very little you're likely going to be able to do in time before the concert. If you can find someone you know, perhaps could arrange to meet them and hand the tickets over one you collect them?

    Sometimes the moral (or even legal) high ground isn't the most sensible option. Especially if a workaround in the meantime is possible.

    the concert is at the end of january i don't know anyone personally who would go so would have to use one of those ticket reselling sites but they don't allow that to happen as tickets must be sent by registered post or courier

    I was speaking via email but today ive had phone conversations the last being with a manager but still not getting anywhere as they keep having to go away to speak to head office.

    I dont think im asking for much to have the order they cant fulfill cancelled with out cost to me so i can get tickets to suit the remaining members of the party now even if that means moving to a higher band but i dont want to do this if it means losing almost £5o in booking fees and paying at again for them

    Phone star and see if its something they can help with. Perhaps not as its a self-regulatory body (run/paid for by the ticket providers) but you never know!

    I mean its not even as if you're asking for a refund on all 6 from my understanding of your posts - just for the two who really, the new seats are not an equivalent for.

    well i have asked to refunded on all 6 as the 4 that are unaffected by the change of seats would prefer to have better seats than we've been given and are willing to pay the higher price as there's still plenty available

    As stated we only went for the cheaper ones as it give the best option for the other 2 in the party to enjoy it.

    Ive had an email back from them saying i can cancel order and rebook but id loose original booking fees and have to pay again for the new tickets:mad:
