I purchased a toilet on amazon which arrived later than promised, it was signed for by my plumber and apparently he was supposed to inspect it in front of the driver for damage, does this remove my rights?
When I went to open the box a few days later I found the cistern to be cracked down the middle
JT Pickfords have said that as we didn't inspect the item they wont refund and after looking at photos they are also saying that it looks like it has been used!
Any advice or guidance much appreciated

unfortunately no he didn't but it remained in the hall where it was delivered until it was opened so the damage 100% happened before it was delivered0

I presume JT pickfords are the seller on amazon marketplace?
The terms on their own website are illegal. They cannot put a time limit on claims. For purchases before 1st october, consumers had a "reasonable time" to inspect goods (and only the courts can define a reasonable time so retailer cannot define it). Purchases after the 1st october consumers now have 30 days to reject goods.

Of course your plumber could possibly have damaged it while bringing it into the house. Impossible to say. Is JT Pickford the seller or the carrier? Your claim is against the seller, you have no contract with the carrier.No free lunch, and no free laptop

I have got amazon involved as I purchased via them from JT pickfords
I will now formally reject the goods, if I return them do I have to return the whole toilet as plumber has installed the pan
I know 100% that plumber didn't drop the cistern and also can't believe that JT Pickfords are accusing me of having filled the cistern which is ridiculous! I am now without a toilet and will have to pay plumber to remove the pan and re-install the whole darn thing!!0 -
If the cistern and pan were bought as one item, then yes you will.I will now formally reject the goods, if I return them do I have to return the whole toilet as plumber has installed the pan

Yes you will. That is no-one's fault but yours. Obviously you need to inspect anything that is being handed over - just to protect yourself from exactly these situations.I am now without a toilet and will have to pay plumber to remove the pan and re-install the whole darn thing!!0 -

Glad you got the outcome you wanted. As others have hinted at, these two statements don't make sense. Let's assume no one puts a damaged toilet inside a box and then seals it up. How can you be sure the damage occurred before delivery and not after?
