Ending tenancy agreement - pro rate month rent

Hello

I was wondering if anyone can advise.

My rent renews on the 21st of each month. I am in a rolling contract month to month. I want to leave on the 29th jan - giving 4 weeks notice.

Am I able to do this and just pay pro rata for after the 21st?

Or does it need to end on the 21st?

    It might end on the 20th if the 21st is the first date of your tenancy. You need to hand in notice to end the tenancy at the end of a rent period.

    You can negotiate anything though. If you want to end on the Friday the 29th Jan then ask your landlord.

    4 weeks notice? Are you in Scotland or does your AST specify 4 weeks?

    If neither of the above apply then the important date is when your tenancy started, not the date you pay your rent (although they might be the same). Assuming your tenancy started on the 21st and you pay your rent monthly then your tenancy periods go from 21st to 20th so if you want leave 29th January you'll actually be liable for rent up to 20th February unless you can negotiate pro rata rent with your landlord.

    Speak to your LL, they may be prepared to let you leave mid-rental period and pay just for the time that you're there, but if they won't then the law is as HappyMJ says (of course with the proviso that Pixie has identified about which country you are in).

    The rent period ends of the 20th.

    1) 'rent period' or 'tenancy period'?

    Usually the same but not always.

    2) Did your tenancy start before or after 1/10/15? The law changed then.

    3) 4 weeks notice? Is your rent paid weekly? Or does the tenancy agreement specify 4 weeks? If so, please quote the exact wording, as well as any wording that says what happens after the fixed term ends.

    4) have you discussed with your landlord? He can agree any date to end the tenancy, and any pro rata arrangement.
