waiting to return an item

I have requested to return an item to a seller as the item is not as described. I did not open a SNAD case as I am aware of the damage to sellers. The seller has refused a return and on the bottom of the message it says that my case can be referred to ebay on Monday.

On Monday when I refer to ebay will this then open a SNAD? The seller is now in some state of limbo - either thinking I have accepted his decision or waiting for me to escalate it.

Your only option now the seller has declined a return is to escalate it to ebay. If you need to add any further evidence, do so before you escalate. You will likely be told to return it and the seller or ebay will have to provide you a label to return.
