Bought a reseal expecting new

I bought a new phone from Amazon Marketplace. It was from a wish list as a gift but from an alternate seller as the original one couldn't guarantee Christmas delivery. It arrived yesterday (16/12) with the security seal damaged on one side of the box only. I immediately emailed the seller who says they only sell new items but that I could return if not happy. Are they telling porkies? If I give it and the recipient would rather reject it will we still have time to send it back?

    I don't know how anyone can tell if they are telling porkies.

    Personally I would return the item if there was a security seal that could have been bypassed. I don't have any objection in principle to getting an item that had previously been returned by another customer (and am fairly sure I have had such items in the past - where there was evidence of resealing) provided the item itself was still in perfect "new" condition.

    However if there is a security seal then it is there for a purpose - to ensure the item is as new - and if it has been by passed I would want another item. (Otherwise there may have been changes - e.g. to passwords on the device - that will not be apparent for some time.)

    Return it. Security seals are there for a reason. If the seal has been tampered with the product may have been tampered with. It may not be new, it may be damaged etc.
