PCN crown wharf no ticket

Hi,
I have read through the newbie forum and learnt a lot about how to challenge pcn's. I have looked through my PCN dated 11 dec 15 which I received in the post from parking eye. ( who are mentioned alot in many posts) and checked it against the pofa 2012 para 9 and it all seems compliant. Now I just want to know if it's worth me challenging my notice by not buying a £1 parking ticket as I was unaware I had to buy one..
On 5th Dec I parked in the Crown wharf shopping centre walsall to go to argos. I apparently parked there for 34 mins according to the anpr system clocking me in and out. I'm not from this area and just believed it was free parking ( like most retail parks around by me) after looking on Google maps there is loads of signs stating parking charges etc but I genuinely didn't read them.
Now is it worth fighting a case on this point or would I lose?? should I just pay an inflated £50 charge. (Increased to £85 on Xmas day!!!)
I'm aware of going through popla and sending letters to retailers complaining etc. Should I go ahead with this? If so which way 1st?
Also lots of people keep telling me that they have no legal grounds on getting this money from me as it's a private company.. is this true?? As by the sounds of these posts. They do but it's rare.

Call the site see what they can do. Details are here. Tell them the driver was a genuine customer and the signs were not clear.

Did you buy anything from Argos and, if so, have you got your receipt? Parking Eye do sometimes cancel with proof of purchase (over £30.00?). Complain to Argos as well as Crown Wharf shopping park if you purchased something.0

Send the newbies sticky template appeal, with a final paragraph stating that the driver was a genuine customer at Argos on the day, and here is a copy of the receipt for purchase(s) amounting to £139.
PE almost always cancel with proof of that level of expenditure.
Do that in parallel to a complaint to Argos, so they become aware of the hassle their customers are being faced with by a third party while they are providing patronage to them.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You will still have to appeal the PCN (Notice to Keeper) received in the post within the time frame specified on the PCN. Use the template appeal in the Newbies thread (at the top of the first page (this page at the moment). Do not alter it other than to add "the driver was a genuine shopper, unfamiliar with the area/car park, £139 was spent in Argos. Take a screen shot of your online appeal.
See if Argos/Crown Wharf will arrange cancellation first but do not miss the appeal deadline.

Of course it is, their documentation may not be compliant, they may not have the contractual authority, their signs may not have planning permission/advertising permission, it is not a GPEOL, (Beavis may well not apply in a P&D car park), and lots more. They have a mountain to climb, you have hoops to jump through, it is such a waste of everyones' time.
A £100 "fine" for a £1.00 bilk is excessive, make their greed cost them time and money.You never know how far you can go until you go too far.0 -
Thanks for the help. I have emailed the Crown wharf manager who has replied saying he will contact parking eye and ask them to revoke the notice as a gesture of good will. Must be good news. But not guaranteed. I will attempt the appeals next.0

Don't wait too long for the manager to cancel (PE will also need to confirm that by letter, which they are efficient at doing) and in the meantime miss the PE deadline for the initial appeal, otherwise you will really be faced with an uphill struggle to get rid of this.Please note, we are not a legal advice forum. Hi . Good news!!
Just a quick summary I had sent an email to the manager of the complex who informed me he would ask Parking eye to cancel. I also compiled an appeal and asked for a popla code.
I have just received email confirmation of them cancelling the charge and that I owe no money to them!
