    Thanks for asking your friend Cath. It isn't normal tax on unauthorised payments; I think its made up of three parts - an unauthorised payment charge, an unauthorised payment surcharge and a scheme sanction charge.

    You need proof that your claim form requested a return of the WPS contributions.

    Basically write to them telling them that you claimed the refund at the time you claimed your pension so this tax charge should not be applied. Ask them why it wasn't refunded to you at the time.

    Have they just written to you out of the blue - ie 16 months after paying out on your pension?

    Is the original form or a photograph retained by the administrator?

    Yes, I have had no contact with them whatsoever since I sent off my claim form as requested. I was extremely surprised to receive the letter from them the other day.

    I have prepared a letter to send to them explaining that I do not feel that I can make a choice between the two options at present as the refund should have been a part of the commencement of pension lump sum and would therefore not have been classed as unauthorised at that time. I have said that I want a manager to contact me to discuss this as I do not feel I should have to pay the penalties associated with an unauthorised payment because I filled in and returned the claim form in May 2014 as requested, I have stated that receipt of this form has been acknowledged and I was informed that it was forwarded to MyCSP by secure online data transfer for calculation of the amount of WPS contributions refund. They specifically mention WPS when they acknowledge receipt so I don't see why I should need any extra proof. I have no idea whether they retain a copy of the form or not.

    You didn't actually tell us that though. You simply said they had acknowledged receipt of your claim form.

    No problem.

    Perhaps include a print out of that email that confirms you asked for your WPS refund at the same time as your pension and that you consider the delay to be their fault and not yours so they should be paying any tax that you will have to pay.

    Well let's hope not but I haven't read any good things about MyCSP I'm afraid.
