faulty tablet and issues with supplier

I have problem being passed from manufacturer to point of sale and back again with faulty product. apologies for the words below but this has been going on a while and there is a lot of history.
In Dec 13 my daughter purchased an HP Omni 10 windows tablet from PC world. After 6 months she had issues with the touch screen not working. PC world said as it was a tablet and over 6 months she needed to go to the manufacturer (yes we now know that was wrong

HP help desk got us to do a few tweaks which resolved the issue but the problem kept returning so much my daughter was forced to get a Bluetooth keyboard to still access her information on the unit as you had to do a complete re-install to correct this.
HP then sent out a replacement which worked for a few weeks then failed so another unit was sent out in June 14.
This worked again until May 14 this year when the screen was playing up again. A few tweaks from HP helped it limp to windows 10 release which fixed it again for a month then the same problems returned in September.
HP have said they will send a replacement Omni 10 but it was stopped manufacture in early 2014 so we asked for a different model as we have no confidence in this unit. HP said we are warrantied until the end of January and all they will provide is the same unit and to go to PC world if we want something different.
PC world state as because we have been dealing with the manufacturer (following their advice) and it is over 12 months since the purchase we have no choice but to deal with the manufacturer and their warranty.
As we have had 3 units now and none of which have lasted over 12 months is there any chance of the sales of goods fit for purpose being used against pc world?

SOGA requires you to show evidence via an independent engineers report.It would be required to prove your not fit for purpose on the original item .Item number 3 is the one you have now and i am not sure hoe SOGA applies to a 3rd replacement unit not from the vendor .0

PCW are talking nonsense, as usual. Having pursued a claim initially under the manufacturers warranty does not prevent you from a claim under SOGA at a later stage. However as pointed out above you would need to prove a pre existing fault, with a report financed by you, with no guarantee of success.
I'd be trying to cut a deal with HP for a replacement model of a different kind, as you have tried to do, but you will have to contribute to the cost-you cannot expect new for old. Failing that, push for a 6 month warranty extension on the old model.No free lunch, and no free laptop

HP are offering a new 12 month warranty on the replacement so that will probably be the best way to go as if it fails again we can change it via the warranty.0
