  • Re Hotpoint, my parents were in the same position. I asked Hotpoint about this when they contacted me and they said it was not a problem, just to contact them in the same way as everyone else. As it turned out my parents' machine was not a faulty model.

    As has been said above they aren't asking for proof of purchase from anyone.
  • You have no contract with the manufacturers, so I don't believe they owe you any "duty of care". (also, you could have got it from a tip for all they know)
    I personally wouldn't be going in quoting any "legalise"

    At a slight tangent but related. We had a Vauxhall vectra as the third owner. We popped into the Vauxhall dealer on one occasion to have something done with the radio code, and whilst there he picked up there was an outstanding recall he had to carry out.
    I don't believe recalls only apply to the first owner.
  • I suspect that legally speaking a manufacturer would fulfil their duty of care by making it publically known that there is a fault and equipment is unsafe to use (or, as in this case, unsafe to be left on unattended). This would ensure no-one comes to any harm from the equipment. They don't have to provide any remedy themselves.

    However if they did this it would be commercial suicide. Anyone with a recent model would be eligible for a repair or refund from the retailer. This would leave retailers to sort out the remedy themselves, potentially putting them well out of pocket, and very unlikely to stock that manufacturers products again. And any customer told that their appliance was unsafe but the manufacturer was just washing their hands of a repair is also going to steer well clear of buying that brand again.
