Landlord Served Section 21 in August. She now says I can't move out without notice

    OP, just crack on. I don't think you want to read the advise given to you anyway. No point keeping this thread going if you are adamant on your chosen course of action.

    If you get away with it great. If you don't... come back for some more advise you can ignore.

    I have not ignored the advice. I am aware she could take this to court. And my response was she doesn't want to do that in fear of kicking up the dirt - and I've explained some of the issues relating to this.

    I HAVE to take this move, I have to put my child, and our family first.

    Shame you waited 2 years to 'put your child first'.

    As for kicking up dirt? Why would she care that a random judge might think she's a bit of a crappy landlord?...

    Here is where your logic really breaks down.

    1) How do you expect those in poverty to find alternative property without waiting on the housing list? Boiler breaks, so I'm expected to just find somewhere else to live that easily?

    2) Landlord is in the wrong, thus by your logic I neglect my child?

    I suspect you're a landlord.

    You'd be wrong - I'm one of the strongest supporters of tenants rights.


    Plenty of people on benefits manage to ensure safe housing for their children. It's not easy, but that doesn't mean your responsibility as a parent ends.

    Negligence

    Negligence is generally about your landlord not causing you injury or damage as a result of their careless or negligent behaviour.
    For example, your landlord may be negligent if they didn’t do the repair work needed in your home after you told them about it, and as a result you injured yourself or your belongings were damaged. They could also be negligent if they did do the repair work, but did it carelessly or dangerously.
    Clearly you haven't done your own research.

    Injury caused? Sever depression (was placed on medication by doctor due to the stress), plenty of illnesses related to not being able to adequately keep warm (yep, got sick notes for these too). Being forced to live in such a position and put myself in financial misery.

    The landlord has a responsibility to make sure the property can be heated. Your home could be heated with the electric heaters which you chose not to use. I know this because I have done my research.

    I quote with the evidence you asked for, and I'm still wrong. Jesus, some people can't accept they might be at fault themselves. Just like my landlord infact.

    How do you propose I bath without carrying kettles and saucepans up and down the stairs? That in itself is putting myself in a dangerous position.

    How do you propose I heat the house with appliances that cost an absolute fortune? How do you propose I invest in appliances that may use lesser electricity without the funds to do so? Should that be my responsibility if a landlord is at fault?

    You know the answer to this, you're just trying to defend your incorrect position.
