Smart Parking

I have received a 'Parking Charge Notice' from Smart Parking. Am I right in thinking that it is unenforceable and I can just ignore it?

It was received on Saturday and to pay the discounted £50 it needed to be paid by the 4th of December so I am already needing to pay the £85.

Thanks for any advice.

    Only a court can determine whether the charge is unenforceable or not. In the case of Barry Beavis, the highest court in the land, The Supreme Court, decided his parking charge was enforceable.

    But PCNs can be beaten at a much earlier stage than court. Yours via POPLA. So you need to read the NEWBIES FAQ sticky and make your initial appeal to Smart Parking. Their rejection will include a verification code to enable you then to appeal to POPLA.

    The only time you can ignore are debt collectors letters, or if you are in Scotland.

    No. It has not been advised to ignore PCNs since the law changed in 2012, and, no, you are not needing to pay anything. Follow the advice and get the MSE 100% discount.


    As already advised, read the Sticky thread for NEWBIES then appeal using the template letter therein.


    Do not pay, do not ignore, do not reveal who was driving, do not miss the appeal deadline, do not 'phone a private parking company, ever.


    This assumes the event happened in England or Wales, not Scotland or NI.
