Prepaid Taxi Dispute

Comments

  • A bit suspect given that we are disputing he showed up don't you think?

Not really, phone dropped out and text was lost. The phone call rebooted connection to the network and the text came through post call. It's reasonable to have happened unless you can show on the balance of probability it didn't.

£22 between how many customers? Is it worth the effort?

I'm curious as to what you thought the police would be able to do about it?

Yes it is. And it's the principle of the matter. What should have cost £22 between four people cost £52. One of the lads paid the £30 so I'd like to get a refund to pay him back what he's rightly due.

I knew they couldn't do anything. I asked if it was a civil dispute and what we can do in that case.

You need to keep this simple but it looks like you're going to over complicate it.

Your loss is £22 and as it stands someone else got you home and it cost them £30 so as it stands you'll be paying him £8 out of your own pocket if you win at court.

If we used a taxi service, didn't pay and do a runner. What would they do?

Yet it's OK for them to take payment and not provide a service? I'm not trying to take them to court but if there is anything that would help to get a refund, that is what I am looking for.

I don't see why we should be £22 out of pocket.
  • As already said time for a letter before action.

However if the taxis data recorder shows a vehicle positioned at the pick up point between 2 and 2-20 the court may well rule you got the time wrong.

Probably call the police as you would be committing a criminal offence.

Try a charge back in your credit/debit card.
Failing that put it down to experience if you're not looking at going to court.

Complain to the taxi authority at your local council. They'll contact the company involved and even visit their office (if necessary) to view their records.

If its all done by computer there will be a log of pretty much everything - including where any particular driver was at any particular time and at what time their system sent the text.

I take it no text was received confirming the booking details? Was a mobile number asked for/provided when booking the hire?

If there was a taxi there at 2am and you don't have something to prove you booked for 2:30am then I'm afraid I don't fancy your chances of getting anything back, its not exactly uncommon for people to miss their taxi and then try and insist that no taxi turned up.

So what's the difference between a cab driver who probably didn't turn up and pocketed the money and someone who doesn't want to pay and does a runner? Aren't the two criminal offences?
