    I don't think you do when they're not also "prepared and able to exchange unconditional contracts for the sale of your property".
  • So davidmcn, this means we have agreed terms and have set an exchange date? Presumably if we can't agree terms or reject the buyer's terms with good reason, then she cannot be termed 'ready, willing and able'.

    Before getting too embroiled in the legal definitions, maybe say to the EA something like:

    I think this buyer is time-waster, I think we should put the property back on the market. What do you think?

    If they agree that the buyer is a time-waster, you have nothing more to worry about.

    Typically, you have to give 4 weeks (or occasionally 2 weeks) written notice. Check your contract.
  • Hi eddddy,
    We served the 4 weeks' notice so that we could move onto another agent straight away if necessary (although it is Christmas etc).
    The EA has been making what feels like excuses for the buyer for some weeks now, only really starting to apply some pressure when she had clearly ignored their instructions and I reminded them when their contract was ending.
    They also said there had been no other enquiries so it will be interesting what data they pass onto a second agent if it comes to that.
    Oh, and they also turned up 30 minutes late for a viewing and our tenant showed the couple round!

    She told me she's not sure if she's going to do a survey at all, didn't mention waiting until the tenant has left.
