    If the answer to that is yes, then they could get away with making yours a pool of one. Your case on this one is not clear cut.

    The switch from CEO to MD PA is much more clear cut, they forced you from CEO PA to MD PA while you were on maternity, and threatened, you with redundancy which is clear cut against the law.

    I don't know the best way forward, but without dredging up the past I don't think you're onto a winner.

After speaking to my solicitor - who advised I tell them to go through the proper channels to ensure I don't get into trouble from the HMRC.

    I should also mention there was a round of PA redundancies early this year and 7-10 PA's were in the pool and the result was that 3-4 PA's were made redundant. However I wasn't pooled that time.

    I am prepared to take them to an Employment Tribunal if the case is water tight, as I know how they've mistreated me for a second time and they've been quite bullyish with their whole approach but following my meeting yesterday they said they will let me know the outcome by next week. So will wait and see



    Are you sure you explained it right to them, as redundancy pay package on top of stat isn't taxed and does appear on your wage slip
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Yes I was technically the only PA to the MD, however the MD had 5-6 Regional Mgrs that reported to him who also had PA's - who weren't put into the redundancy pool - I have to add that they are dotted all over the country. I was fairly mobile and worked from home as well as London/Birmingham/Southampton or whereever I was asked to travel to. So with that in mind they should have pooled the London PA in as I could have travelled and worked there (as i did so for 3 years previously)

    It is a little complicated. However the move from CEO PA to MD PA means today I am in a position of where I am being made redundant. If I was given my old job back when I returned from the first time I would still have a job.

    When I asked the CEO when I went on mat leave the first time round why they are recruiting another permanent PA I was advised that there was a need for 2 PA's in that office even though to date there has only been the one. I asked why they couldn't place me in the London office as they said they needed two PA's in London to which I received no reply.

    Redundacy payments can go on Pay slips as a not taxable payments upto £30k. as can the taxable bit that does not attract NI.
