Planning permission how many times can you apply

Hi

Over the last 3 years someone near to us has applied for planning permission to build flats and 3 times it has been refused.

I was told at the time of the 3rd refusal that they could not now apply for planning permission without waiting 5 years, so we all breathed a sigh of relief.

However they have just applied again and I presume the application has been allowed as the council have listed it as a valid application.

Was the 5 years an old wives tale?

    I suspect it depends if the application is the same or different.

    They can apply over and over again if they take into account the planning officers views from applications before. They normally give enough information to enable the applicant to get planning permission eventually.

    It does depend on what the issues have been with recent refusals though. If, for example, the principle of development is completely unacceptable, then no amount of tinkering or changing it will result in an approval.


    An LPA has authority to refuse to validate repeated or vexatious applications - i.e. ones that are just repetitive. However they must be virtually the same as a recent refusal - if the applicant has changed it at all, the LPA would be on shaky ground in the event of an appeal against non-determination.

    Planning permission for a block of flats next to mine was refused 3 times. Each new application was tweaked slightly to take into account the objections. They got it right on the 4th application.
