"Smart" Parking fear

  • Im going to go and take pics tomorrow of the signs and the space I was parked in as there were no signs there stating anything about having to pay etc. Also going to write to Matalan CEO & Smart parking to appeal. I absolutely want to fight this as others are clearly getting stiffed by these cranks!

I disagree with Redx, say that YOU were driving, the POFA has little relevance here .

What's your reasoning behind that statement?

If it is to do with EA2010/protected characteristics etc. then the BB holder does not necessarily have to be the driver, could easily be one of the passengers.
On that basis, is there any need to throw away a possible obstacle for the PPC to make the charge stick?

I cant find this newbie stickie thread! :(

Thank you, what is an EA2010?

I cannot find this stickie thread

You really must be more pro-active. if you are not prepared to help yourself, no-one here will help you, after all, it is hardly rocket science.
You never know how far you can go until you go too far.
  • I am trying to be pro active, I wouldnt be asking for advice otherwise.
  • I have written strong letters to Smart and Matalan today, quoting the advised literature. Thanks to those who posted positive, helpful responses...I will keep you posted! ☺
  • **UPDATE!** MATALAN EVENTUALLY AGREED TO INTERVENE AND SMART PARKING HAVE CANCELLED THE PCN!! I also now have free parking at this Matalan for 1 year, result! Thanks for all the advice guys, keep on fighting!💥👊💥

Wow, great result and well done you!

Was your contact with the local manager or with someone else further up the food chain?

Nice Brucie-bonus with the free parking, but have they given you an idea about how they will keep the PPC off your back for the next 12 months? Are they having your VRM white-listed? You need to be careful if you're using a different car, because you're likely to be in the same boat again with a fresh PCN then.

Don't mean to rain on your parade, but forewarned is forearmed.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Thanks! I requested CEO contact details and though they initially refused to intervene, with a little 'encouragement' from me via social media, they agreed to speak to smart and the PCN was cancelled!

I have been "white listed" as you mentioned, by registering my vehicle details with them. Thanks for the heads up about changing my vehicle, I'll bear that in mind if I do :)
