Job title change-what next?

My son is a supervisor at a large well known works and a new operations manager has come in and because he doesn't like some of the supervisors he has decided to rename their job role and make them all re-apply for their own jobs.All have been told those not sucessful with be offered other jobs without a drop in pay.They have all been told their current role is been made redundant (re-named) but my son have been offered another job with another company today if he can start on Monday.He wants to take this job but his current contract states he has to give 2 weeks notice,can anyone tell me legally where he stands please?

    He has to give two weeks notice. If he doesn't, there may or may not be consequences - he has to decide if he is willing to risk it.

    A friend of mine left with no notice (the company had a history of not paying the last month of wages, so he left with no notice on pay day). He was sued for the cost of a temp to cover his notice period. The company won.

    Contractually he is not in a position to take this role. He is contracted to another company and he would be in breach of that contract if he did not work the 2 weeks notice.

    However there is no reason why he couldn't try and negotiate. Two options which come to my mind, inform the new company of the position and ask to start the new job after the notice period. This also has the advantage of demonstrating a high degree of professional integrity. Second ask the existing company if they would forgo the notice period.

    I would be inclined to try option one first, most companies realise that notice periods from former employees need to be honoured and 2 weeks is not long at all.

    Good suggestions - but parent posted Saturday and job starts Monday, so there isn't really any time to negotiate with either. Assuming the new employer made an offer on Friday, and wants someone to start in two days without giving notice, I'd query what kind of employer they are if they don't believe in employees giving notice. But equally I would be most annoyed if one of my employees simply rang in to say they were quitting today - or worse, didn't ring in at all and simply disappeared. If I could action anything I'd be inclined to do it, and, of course, the employee had better hope they never need me as a referee, because it's not going to be a very positive recommendation.
