Just want to check on this, I'm almost certainly finished with ebay, due to non payers and sellers who take an inordinate amount of time to send items that were paid for instantly.
Seller had stated that they would dispatch within 2 days, on the 7th working day, I asked for a refund because I was sick of waiting and the seller hadn't been in contact regarding the delay.
About 15 minutes later, tracking info is uploaded to ebay, and I got in contact regarding what had happened. Not too happy that there had been no contact and then as soon as I ask for a refund the item is marked as shipped.
Regarding the latter comments in sellers reply, I had stated that I might not sign for the item as a possible option, the reply makes it sound like I had stated I was refusing to do so in an absolute manner. I hadn't.
Does the seller have the right to demand that I return it Special delivery? Reading ebay's rules it led me to believe that it only needs to be tracked. Signed for counts for tracked under Royal Mails definition. This is also the method that was used to send the item to me so it seems unreasonable.
Truth be told, I don't have to return the item, but I am curious as to what my options would be.

You just need to return the item tracked. Not necessary to be Special Delivery. Depending on the item you could return it by My Hermes for far cheaper.
If you thought the item was not as described. You could open a case for not as described. The seller would most likely have to pay for an Ebay tracked returns label.
Ebay listings say a lot of things and often they quote Ebay terms and conditions at you. Some sellers rely on the fact that buyers are ignorant and won't check what Ebay T+C actually say.0 -
Regardless of what you do, do not forget to leave feedback based on the delay with no contact and whatever else happens.0

Ok, thanks for this, I thought it might be the case that he was trying to pressure me into just accepting the item and not returning it.
I did read in the help section that undue delays can count as 'not as described' but the example they gave was concert tickets that arrived after the date of the concert. Yeah, I left negative feedback for the seller. Massive delay, no contact, then frankly dismissive contact after I asked for a refund.

I think it was pretty clear but no matter....

The discussion continued with me saying that that is unreasonable and as such I am willing to wait the time out to see what ebay say.
The Resolution Centre seems reasonably horrible to use. I opened a INR case, and don't seem to be able to change that to a returns case, until at least 8 days have passed and I can escalate it to ebay.0 -
I stopped responding to the guy last night, because frankly the back and forth wasn't getting anywhere, however I got this unsolicited tonight:The seller has responded to you and offered another solution to resolve this issue.
Seller's message:
'TERMS AND CONDITIONS OF RETURN: 1) The item is returned by Royal Mail Special Delivery. This is to guarantee that the item is returned to the seller and offer full protection to the buyer. 2) The item is returned in the packaging it was sent in, unopened. This ensures that there can be no question of the item being returned in the condition it was sent. 3) the item is returned within 3 business days of receipt as the transaction was a personal sale, not business. If the above conditions are met a full refund will be made within 5 business days from receipt of the returned item. '
If you're satisfied with this solution, please let the seller know by sending a message in the Resolution Center. If you don't want to accept this offer, we encourage you to contact the seller and offer a solution that you'd be happy with.0 -
I would PHONE eBay snd make it clear that:
- item did not arrive
- you asked for a refund
- seller THEN dispatched item.
Get them to change it to an item not as described dispute, stating that item arrived too late and was dispatched after cancellation, and you want seller to send a returns label.
You then just need to return it with proof of postage.

No, it wasn't clear. But "no matter".
After my original question you state you "have an INR open". But yet you say the seller has responded with returns info???
If you have the item and you want to return the item, you need to do so either via changing the case to a SNAD or to a return.0 -

I appreciate you are trying to help, but this has already been covered in my previous posts.
I opened an INR case because I hadn't received the item. The seller had not been in touch either to give any reason for delay. Within 15-20 minutes of opening the case the seller had uploaded tracking info. I sent a message asking !!!!!! had happened, discussion ensued, it was at that point that the seller made his demands regarding any potential return once the item had arrived.0
