Tax Credit Decision

Hi to all,
I am living at the UK for more that one year.
At the beginning I was in here alone, but in Abril my wife join me and we start to prepare everything for the coming of our son, that stayed with my mother in law.
One of the thing that we did, was send the papers for the tax credit, always having in mind that we will needed when my son arrive in here, because of the childcare.
In the summer, we received a letter from the revenue saying that we didn't have any right to the tax credit because we aren't living in the UK. At the beginning I was thinking that was something easy to solve and was a wrong interpretation that we placed. On the form, I said that he was living with the grandmother at Portugal, but me and my wife was working and living in here.
I just contact the helpline to clarify that I was living and working in here, but before of the 30 days after I receive the decision I sent the "Reconsideration form" joining our last 3 pay slips and the invoice of the council tax of the house that we have rented to show that I was really living in here.
The worst came when my child started the nursery (September) and we didn't have any help with the child care, because we have the situation pending with a special team.
I even have sent the invoice of the nursery to the revenue and a letter explaining one more time that he was at another country, but at the moment he was already in here.
We are in December and I don't know what can I do more. Every time that I contact the help line, the only thing that I listen is that they cannot do more because is with a special team and I'll receive a letter with the decision and all the amount that I have right.
Why they don't understand that I need help now?
What can I do more? This is unfair. I always I told the truth and we prefere to work (both) and placed more time in the school, but a big part of the salary of my wife goes to payment of child care.

The decision looks right, your child wasn't with you when you applied. You expect them to pay you from the date for you applied when you were not entitled?
Apply again if your child is now with you.0 -

In this country full-time with you and the mother, or abroad with the grandparent with occasional visits to the UK?0 -
The decision looks right, your child wasn't with you when you applied. You expect them to pay you from the date for you applied when you were not entitled?
Apply again if your child is now with you.

I think that the tax credit isn't just for who have children. On the simulations that I did, I should have right to the working tax and since the date that I started paying the nursery other help for the school.
In relation to the working tax I was able to survive without, but in relation to the amount that I spend with the nursery I really need help.
According with them, I do not need to apply again. Just the circumstance changed and I correctly informed the revenue. They say that can do anything more, because is with the special team with who they don't have direct contact. I am more than happy to clarify everything but seems that the truth isn't enough.0 -

My son is living permanently with us since September and we informed the revenue of that change. Since the day that he has arrived we applied for child benefit but before of that date we always told the true. My son is with the grandmother in another country and of course we are not expecting any cain of help for the time that he wasn't living in here.
I understand what you are asking in relation to "...or abroad with the grandparent with occasional visits to the UK?..." but is really is staying with us 24/7 and since September he just missed the nursery during 3 days. Any doubts, why they don't check with the nursery?
I know that there exist some foreigners trying to cheat the system and I agree to control what they do. But I can not pay for it

It looks a complex situation but it does appear that child tax credits could have been payable with the child residing in Portugal as long as they were financially dependant on the OP

Well, talk with the MP is something new for me and I'll like to keep for the last chance.
One friend, told me, that I should ask to talk with a manager of the helpline of HM Revenue and Customs and say that I'll stop to pay the nursery because they aren't doing their job. Can I do this?It looks a complex situation but it does appear that child tax credits could have been payable with the child residing in Portugal as long as they were financially dependant on the OP

Thank you for the information, but I don't want nothing from the period that my son was in Portugal. My afraid is that the Revenue is trying to get any type of information from the Portuguese government and simply no one will answer.
But these are just guesses, what I know is that for the Revenue I don't have access to the tax credit, because for them I am not living in here.0 -

Do you mean you will say to HMRC you're going to stop paying the nursery?
What have they done wrong!?
If you stop paying the nursery, they'll stop looking after your son. Simple.0 -

Try the MP, just write a polite letter to them and they will get one of their staff to send it on to someone at the Benefits and it may just bump you up the list a bit... Its the MP job to help you.0
