Groupon distance selling law refusal!

Hi all,

I purchased a voucher from Groupon for a local event which can be redeemed through Ticketmaster. After buying the voucher I realised it was more expensive than buying directly from Ticketmaster and I couldn't add a special meet and greet option with the voucher. I wasn't greatly bothered by the money but I really wanted to add the upgrade as it's a present. I have tried calling Ticketmaster to see if I can add the option but have given up on their call centre. I then tried to cancel the vouchers with Groupon. They have advised me that although I am well within the 7/14 days cooling off period the vouchers small print preclude cancellation for a refund.

My question is I thought the distance selling law could not be nullified by conditions of sale small print so where do I stand in relation to their reply?

    There are no cooling off periods for events. The old DSR and the new CCR both have exclusions for concert tickets.

    It is a distance sale, it's just that events like this are excluded from cancellation rights.

    Groupon weren't contracted to supply leisure activities on a certain date or within a specific period of performance though.

    Regulation 5 of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 states:
    “distance contract” means a contract concluded between a trader and a consumer under an organised distance sales or service-provision scheme without the simultaneous physical presence of the trader and the consumer, with the exclusive use of one or more means of distance communication up to and including the time at which the contract is concluded;
