Company sent out the wrong order and are refusing to send the correct one

I bought some clothes online in the sale. Package arrived on Tuesday and it was the wrong order. I emailed them immediately to advise them and to ask what to do.

They said take some photos of the product with the tags still attached (fine), send the order back by that day (no can do, my day was filled yesterday and will be filled till Monday so I can't make it to a post office till Tuesday), and once I have provided them with proof of postage they will send the correct order out to me.

I emailed back to say I couldn't post the parcel yesterday and that as this was an error on their part and not an exchange I expected them to send out the correct order without delay. They said that this was not their procedure and I must provide proof of postage before they can sent my order out.

I've paid for the item, I don't want the wrong order that they sent me so why are they holding my order to ransom?! Can they do this?

    It seems reasonably fair (to me) that you return the goods before they send out your order otherwise they risk losing that first order.

    Granted they make mistakes but you appear to be putting up barriers to get it fixed.

    Legally they have not fulfilled the contract as they haven't sent out the original order therefore they can't hold the Op's order to ransom - they need to fulfil it whether she sends the wrong order back today or in 2 weeks time or whenever.

    However, for the sake of ease I would just send it back rather than argue the toss over it.
  • I have a funeral today, an all day meeting tomorrow, a day out with friends on Saturday and am travelling all day on Monday. Had i known I was going to need to post something i would have factored it into my plans, but it's not my fault that they sent me the wrong item.

    Why should I have to wait for my order when they made a mistake?

    I would also be really cross that they are holding your own order to ransome despite it being their mistake.

    You could just cancel your own order and tell them to send a courier for the wrong order?

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    There are plenty of other options for posting parcels these days... You can use Hermes or Collect+ through your local corner shop, many of which are open late 7 days a week.

    Do a charge back on your credit card if paid by that method?

    In all fairness to the op I wouldn't be able to send back as quickly as they tell op to, my local post office opens 10-4 I work 9-5. Too far away to make it on lunch break.
