Accident at Work - Settlement Advice

Hi all,

I was just after some general advice re an Accident at Work. The story so far…

Accident at Work 2 years ago.
Off for a few months.
2 Operations.
Life long disability - not major, but life affecting.
Instructed Solicitor.
Employer Accepted liability.
Solicitor now preparing damages.

This is where I'm confused / worried.

The Solicitor originally provided a ball park figure for the case (can obviously never be assured). After medical reports, witness statements, they came back and said although the injury is looking bad, the claim is looking 'better'.

We have received an independent report from a third party through the solicitors detailing past and future costs and values.

The past cost come to a figure, but then the future costs / values run into 6 figures.

This is made up of a figure needed per annum * life expectancy. Im 40.

These figures are made up of a cost of a cleaner, carer * hours per week, change of car per years, special equipment and cost of replacing etc.

We are due to sit down with the Solicitor in a few weeks to finalise the costs / values.

My questions / worries.

1) How likely is the defendant going to question that i need care / cleaner etc?

2) The Solicitor has said the figures are high as that is what it would cost a professional to do it (clean/care). As its my partner that has to do these things - the defendant will see the true value as less - how much less?

3) Anybody any experience of a claim showing X amount of pounds on paper and what the defendant will offer. At the moment with it showing 6 figures its a life changing sum, but if as a general rule - cases get settled for 10% then its not.

Any advice / reassurance of what happens at this stage would be great.

Will obviously be asking Solicitor but that is a few weeks away.

    The claim will be supported by expert witness statements of your needs for the rest of your life


    The fact that your partner will be caring for you is irrelevant - she may not be able to do it for the rest of your life!


    Speak to your solicitor for the reassurance you need over how much you will be getting
  • Friends and family members doing care and assistance tasks for you, although not incurring fees, can be claimed for as "gratuitous care" and the going rate is around £6.90 / hour once it has been negotiated down.

    As said, seek advice and reassurance from your solicitors as they are best placed to advise.
