Parking ticket on sold car

Hi,

I am just looking for a little advise before I proceed. Would be greatful for any help.

Basically the guy who brought my car went and got a parking fine the same day of the sale and I think i'm stuck with the bill. :mad:

I recently sold my car. It was a private sale on the morning of 13th Nov. I ofc sent off the verchile 'change of ownership' notification the same day and this has been cleared and the car is nolonger in my name dated 13th nov.

However I recently received a parking fine notification through the post. It states my old car was parked in a civil owned carpark (parking eye) for 30 mins on 13th of Nov at 14:23pm. The new owner got the ticket on the same day of the sale.

I am worried the parking company won't accept my appeal. I can prove the car changed hands that day I even have a receipt but I can't prove the time it changed hands. A failed appeal will cost another £40.

To avoid wasting £40 on a hopeless appeal, can you guys tell me if this is worth fighting?
some details:
  • Ticket is from a civil parking company (parkingeye)
  • DVLA confirm car changed hands on the 13th
  • Car is currently listed and registed to trade (forget exact wording)
  • Have scrappy hand written receipt
  • Have mobile number of buyer (since found out he is trade and not private as stated)

    If you send them a copy of the receipt you gave the buyer, that should sort out when you sold it.

    The receipt does not have a time on it unfortunately. I guess what I'm asking is:

    Do I have to prove the time I sold the car or will it be enough to prove I sold it that day?

    Have you had a word with the buyer,
    If he is honest, he will back you up. If not, then you will just have to appeal.

    It is up to them what they accept. But not actually being the keeper of the car when it allegedly trespasses on their property is a fine defence.

    You can simply tell them, hey I confirm I am one of the FORMER registered keepers of the car reg XXXX that you allege was in your car park on the afternoon of 13 Nov.

    This car was sold by me on the morning of 13 Nov to Mr Y of ABC Motor Traders at address Z. At the time mentioned in your letter, the registered keeper of the car was Mr Y/ABC Motor Traders ; he had ownership of the car and responsibility for, and control of where the vehicle was kept from the time of sale on the morning of 13 Nov. I attach a copy of my record of sale and DVLA's records will confirm that the car ceased to be registered in my name effective 13 November. If you require compensation for Mr Y's car being on your property I suggest you follow up with him. His contact details are: zzzzzz

    where you paid by bank transfer?
    did you ring your insurer to cancel or transfer the insurance?
    did you get proof of postage when posting off the V5 , or did you use a debit card for this and other items at the PO?

  • 13th of November starts at 0.00 Hours on the morning of the 13 of November.
    Therfore you were not the registered keeper on the 13th of November.

    Inform them there is no keeper liability as you were not the keeper and DVLA should not have issued your details as the keeper when they knowingly sent you a letter stating you were not the keeper.

    This is why I always write the time down on the paperwork and ask the buyer to do so also

    Parking Eye cannot fine anyone - Stop giving this speculative invoice more creedence than it deserves!

    Strange one, if I'm caught on a speed camera at say 7am today (26/11/15) and sold later at at 11am. It wasn't me as I am not the keeper that day?
