Capital Cooling and Smeg atrocious service

I ordered a Smeg minibar fridge from a company called Capital Cooling. Service was great prior to ordering. Then it plummeted.
The Smeg fridge had manufacturing defects. The ice tray section was not level so useless if you want ice. Also, the manual said it was 32L but the advertising said it was 40L. I contacted Capital Cooling, who then got in touch with Smeg. Smeg said it was a misprint. I assume all the other documentation saying 32L was a misprint too.
Its been 2 weeks and they still have not collected the faulty fridge for replacement. I have contacted both Smeg and Capital Cooling. The latter said they are waiting for a reply from Smeg. Smeg said they contacted Capital Cooling a week ago. Each blaming one another.
Smeg did the delivery, FYI.
If they don't collect it after a certain amount of time, do I get to keep it and still get a refund? Its a constant source or irritation, taking up space.

The manual clearly says that the capacity of the ABM42 is 40 litres.
The manual does cover another model, ABM32, which is claimed to be 30 litres.
What is 'all the other documentation saying 32L' that you mention?
With regards to the crooked ice tray, are you sure the fridge has been installed perfectly level?

They updated the manual when I contacted them about it. They said it was a misprint. But all the other leaflets with the fridge also say 32L. Spec sheet, fridge sticker.
The ice tray section was all bent out of shape. Its a clear manufacturing defect.
The commercial channel director of Smeg said this to me:
"Quick question though – I recall you wanted the minibar to store food so can’t imagine the ice tray to be of much use to you in an office environment? Also have you tried to straighten the metal plate the ice tray sits on?"

They updated the manual when I contacted them about it.
Hmmm... I am finding that difficult to believe.
That copy of the manual I linked to is not on Smeg's website, nor on your seller's website.
It is on RH Hall's website - another seller.
That version of the manual is dated October 2008.
OK, I can almost believe that the paper manual shipped with your product was mis-printed, but for you to suggest that SMEG changed a third party's website after you pointed out a problem is not believable.
Anyway, as the advert said it was 40 litres, and it turns out the product is in fact 40 litres, apart from the bent ice tray support, what exactly is the problem?
I suggest you do as the seller suggests - try bending the ice tray support so that it supports the ice tray properly.
As you have now confirmed that this is a business purchase, there is no consumer legislation that will help you.
You need to look at the terms of your contract to establish whether you have any right to return.0 -

I showed you a manual stating '40 litres'.
You responded that they changed the manual after you informed them of their mistake.
I pointed out that it was a 2008 version of the manual that already had '40 litres' in it.

There is a big difference between me saying they updated the manual and me saying they updated a 3rd party website. The two things are not the same and to suggest they are means you are not thinking clearly.
Your silence on those two other links suggests you now know I was not lying. But your lack of apology suggests you lack common decency.
We don't know for sure if its 32L or 40L. Different manuals saying different things. The individual suggesting its 40L could be as wrong as the person doing the manual.0 -
