self assessment tax return

Not sure if this is the right place i have just git two letters saying am late with my self assessment tax return. i never get the letters. it says from 2012 and 2013 so its a 200 pound fine for begin late. but i am not and i have Never been self employed.. so why am i getting this i been with my job now at the coop since 2011 . i rang them today and got no were am not sure what to do thanks

    Self Assessment is not only limited to people who are self employed. HMRC can request that anyone complete a tax return for any in date year.

    As you say that you have been employed during 2012 and 2013 then it is most likely that HMRC have written to you over the past 2 years to let you know that you have underpaid your tax.

    It seems that for whatever reason they have not received a response from you regarding this underpayment and therefore they have moved the assessment of the 2 years into Self Assessment.

    They do this to make the assessment formal, unlike the assessment they have issued previously which was informal and recoverable only by way of a voluntary payment from yourself.

    Now it's within Self Assessment any balance due becomes a legal entity and HMRC have greater powers to be able to collect any tax due and charge penalties if tax returns/payments are late.

    If you didn't receive the Notice to File letter which told you that you needed to submit the forms then use this as the basis for your appeal. Follow the instructions on the back of the penalty notice and submit your appeal.

    Then fill in the outstanding tax return forms.

  • Since this thread touched on an area I have an issue with I thought I would add a comment. I have been asked by HMRC to complete a SA for 2014-15. I opted to do it online thinking that I could cope with that and also I think I did the same back in early 2000's. BUT I never anticipated hte trouble I would have trying to get online. HMRC have sent me the user ID but I cannot get the 'gateway' to register me. I have been on the phone 3 times to HMRC - with about 40 mins of that waiting in a queue - and also emailed but not made much progress. I am now very anxious that I will run out of time to get registered and complete the process before 31 Jan 16. Although the deadline for paper submission has passed would I still be able to ask to submit by paper? Would HMRC allow that since getting online is being such a trial?

    It's possible that HMRC have mistakenly asked you to complete a SA return. If your personal affairs are simple and there is no need to do an SA return, you can ask them to withdraw their notices to complete a SA return. It could be that you've changed address without telling them, so they've been writing to an old address, hence why you've not received their letters. All this could be sorted out with a phone call to HMRC to have a chat about it all, sort out why they think you should do a SA return, sort out the address situation, and hopefully reach a welcome conclusion that they'll withdraw the SA return notices. Some say that when they've asked for one, you must complete and submit it, but in reality, they can waive it if it's clear that your tax affairs are in order without a SA return.
  • Thanks I'll try that. However there is no issue with post addresses as I have received letters from them as recent as 11 November. The issue seems to be that the user ID / email address or UTR are either wrong or don't match up - hence I cannot proceed to register for the SA service on the gateway. I have phoned 3 times - with varying degrees of success.
