The CPR does not apply to "sales" but price comparisons. The CPRs "prohibit traders from giving false or misleading information, or omitting material information, about price or the manner of calculation of the price for a product, where this causes or is likely to cause the average consumer to take a transactional decision he would not otherwise have taken. "
If the discount applied only to those customers that quote a code (e.g. given in the press) then I think they could argue the price comparison is clear (i.e. the comparison is with the price other customers pay i.e. those that don't have a right to a discount). But if there are signs up in the store, or the discount is promoted by staff in store so that all customers get the discount, then I think it is not clear what they are comparing the discount to. Surely the average consumer would think they are comparing the price with a previous price, yet as that previous price has not applied for 28 consecutive days they should be making that clear. I mean putting the price up before marking it as 10% off in store, albeit with a code, seems self evidently designed to mislead. Why are they doing it otherwise?
That said I suspect the matter has not been tested in court, so Curry's will argue it is legal.

Was it £225 or £329? You've said two different prices in two posts...
None of your percentages add up. £40 is 10% of £400, but the price you're talking about now is only £300.0 -

I contacted Resolver on the 25th, Currys haven't responded to them ... as I didn't buy the item from Currys I don't expect any kind of result ... I just wanted to make my point to Currys and maybe get an acknowledgment - I won't hold my breath !0

Yes ... of course, my comment "I haven't heard yet" was not an impatient grumble just making the point that I had not yet heard anything back yet (because it was too soon to expect a reply) ... when I get a reply I will post it.

We understand that you were browsing for cooking hobs online. You noticed one on Currys but did not buy straight away. You came back t it at a later time (25th November) and noticed that there was a Black Friday deal tag for 10% off but the price was more than stated when you first saw it. You think that this is illegal and want to report it.
Your rights and obligations
There is no actual breach of consumer law by the trader in this instance. A trader is allowed to charge whatever they price they wish for products so long as they are making the consumer aware of that price before paying. The 10% off could be from the original price when it first went on sale through the trader. We will still notify Trading Standards about the business practices.
What we’ll do
We’d like to notify Trading Standards about this issue. Trading Standards are part of local authorities so we’d need the traders full address details to pass the information to the correct location. Whilst this doesn’t help you resolve your problem, it gives Trading Standards vital intelligence about how the trader operates their business.

Was it a 10% price reduction, OR was it a 10% price reduction with a code. (such as save 10% off All hobs over £250).
Two very different things.
The first scenario, very possibly broken the rules.
