New Job Holiday

Been here a month, taking 10 days off which they knew about in interview but refusing to pay. As I haven't acculmated enough days.

It was never said I wouldn't be paid, where do I stand?

    It sounds like your employer operates an accrual system where you can only take leave that you have already earned. Assuming they aren't telling you when you must take all of your leave then they would need to pay you for the leave that you have accrued in the time you've worked (so for a month that would be one twelfth of the leave allowance, probably a bit over 2 days) but you'd have no absolute right to be paid for the rest of the 10 days.

    In my opinion you are lucky to get the days off and you are only entitled to be paid any you holidays you have accrued. They don't need to pay you.
  • Stands to reason that you'll only get paid for days accumulated. You informed them of a pre booked holiday but surely you must have realised that, being the end of the year, you'd only have so many days paid leave?
  • 1.66 days per month, 4 days pay instead of 10.

    Not a happy bunny, I might aswell go back to self employed with poor holiday rules and no sick pay. Don't even a shut down over Christmas.
  • I would try negotiation with them. Point out that you don't want to take more than the holiday allowance in the holiday year. Say that you quite understand that you haven't accrued this holiday yet, but you will obviously accrue it later in the year. You are happy to have the pay withheld now, but could they repay you these 10 days' holiday pay later in the year.

    If they won't, make damn sure you take your full holiday allowance! :D

    It'd be strange for any company to pay someone days off they haven't accrued? Not down to silly rules I'm afraid...

    If you have only been there a month, work full-time and take your holidays now then you are entitled to 2.4 days. When are you starting these 10 days?

    No shut down over Christmas but are you off Christmas Day, Boxing Day? When does your holiday year run from-to?
