advice on non fault claim

hey guys
in september some one reversed into my other half car, she admitted it was her fault and wanted to go through insurance. My misses rang up her insurance, they collected the car took it for repair and we had to pay £300 excess.
When we paid the excess her insurance said they'll be claiming it back off the third party insurance as its their fault. Any way 3 weeks went by heard nothing so my misses has rang them to be informed that because her renewal came up and she's gone some where else they cannot carry on with chasing the money up and shell have to ring the third party herself to get it back.
So she's rang the third party insurance direct (admiral) to be informed that she cannot claim the money back herself and her previous insurance has to do it. Also the third party hasn't rang them to let them know about the accident and until she does so they cannot pay out the excess (even tho they've repaired the car?)
Would just like abit of advice of where to go from here, Rather annoyed that its some one else fault, we've had to pay £300 excess and no sign of getting it back.

Unless you have legal cover, it is often the case that your own insurers will not claim back uninsured losses for their policyholder, such as the excess.
The fact you have gone elsewhere and they now say they won't assist anymore seems petty, but there is no obligation for them to recover the excess for you.
Admiral are talking rubbish saying your missus can't recover her excess directly from them. However, at the same time Admiral sound like they have not yet been able to validate the claim as the third party has not been in touch with them to confirm they damaged your missus' car, so until Admiral get this confirmation from their insured, or a county court summons, they may well sit on their hands and do nothing.
So, do you have legal cover with the policy that was in place at the time of this accident?0 -
Unfortunately not we didn't take out legal cover (wish we had now). Tried contacting third party with no response0

Also make sure you have not declared it as a no fault claim with your new insurance.
As things stand that is not the case.0
