bought new flooring they now want more money

Hi,

I've spent the whole of this afternoon looking at new flooring. Finally decided what I want paid for it, it was a roll end.

They have just called me and want £160 more, do I have any rights?

They are refusing to let me have the flooring it is obviously still in the shop as I was waiting for the fitter.

Really disappointed and a wasted day.

Any advice greatly appreciated.

    Would you want them to fit the flooring if they are annoyed that they sold it for less than the should have They will likely do a shoddy job to get back. Just ask for a refund and go elsewhere.

    And if they did, OP would have consumer rights - as there is an expectation that if someone is taking money for a job, then they are of a certain level of competence.


    OP, what was the actual agreement? Have they made a mistake in calculations or amount provided vs what was agreed?

  • We had an independent fitter. Just annoyed that I have wasted the day.

  • They said they used the wrong price for the calculation. As it was a roll end it wasn't marked up so I don't know what price it should have been. I only know the total price we agreed.

    They made a mistake, people do, including me and you.


    Just ask for a refund and go elsewhere or look further in their shop.


    Learn from it and take a calculator with you to check.

    Roll ends are usually fixed prices so I honestly don't know what has gone on here!

    A family member of mine runs a carpet shop and their roll ends are fixed prices. Sometimes they are more than happy to sell them at the listed price because roll ends can sometimes be tricky to shift.


    Not sure what has gone down here, but £160 extra should be met with the phrase "jog on"

    Offer + acceptance = contract is formed.

    For example if you agreed £19 per m and they calculated it at £1.90 a m, you would owe them the rest. If you agreed £19 per m and that was the figure used in their calculations, then a contract was formed and can only be void under certain circumstances - such as a unilateral mistake - where one party makes a mistake and the other is aware - or should reasonably be aware and takes advantage of it.

    Norhing to lose at this stage (unless you paid by cash - in which case retailer could be awkward and make you take them to court to get a refund of sums already paid) by seeing what they say.
