    lets say the debt was £5000.00 you would be looking at payments being instructed via the Courts of £5.00 per week and then if he fails this it is further monies needed by you to enforce said debt.

    He can be instructed to pay me 5$ a week? what do you mean by if he fails further money is needed? will i pay anything if i lose?
    before he started the business i told him i am out and i have that recorded on a phone call isn't that enough proof? he's claiming that i am his partner and that will prove that i wasn't.

    You cannot get blood out of a stone. If he doesn't have any money, he cannot be forced to pay you.

    Have you considered reporting this as a crime?

    How is it a crime - you gave him the money.
    The police will say that it is a civil matter.

    I dunno. It's a bit of a grey area. Had this been a simple business deal that had failed, I'd agree with you. But the OP does state that they asked for their money back before anything had been carried out, and thus there's a possibility the police would treat it as theft.
