removing a default - please look in

hiya

i got a default from a debt collection agency regarding a credit card with capital one. I never got any letters regarding this and only way i know if when i checked my credit report.

Can you please help me get this removed as i think its unfair and the company bought the debt and gave me a defualt straight away.

    THe credit card companies don't just sell a debt because you miss one payment.

    Somehow I doubt you're telling us the whole story.

    And no, you can't get a default removed.

    you dont need to know the full story, the debt was sold on and i got no contact at all from the new company who bought it over and then this yr i find out they gave me a default. now this cant be legal. thought they had to inform you before doing it?

    How do you expect people to give informed and effective advice with only half a story? I relize it may be a tense situation but the comment "the company bought the debt and gave me a defualt straight away." just doesn't ring true, with me anyhow. Sorry if you disagree that's just my opinion

    Car - was - [STRIKE]20867[/STRIKE] - now - Gone! :T Zopa - was [STRIKE]6800[/STRIKE] -now - Gone loan - was [STRIKE]1687 [/STRIKE]- now Gone! :T Student Loan - was [STRIKE]1850 [/STRIKE] - now gone!! - Barclay Card was -[STRIKE] £2000[/STRIKE] now - Gone OD - was 1100 - now - 900 :mad:
    Total - £0 :rotfl: + OD = 100% paid!!!

    How many months' payments did you miss?

    A CC company doesnt sell a debt just because they feel like it. You must have missed payments for them to do this. and THAT is why you will have been defaulted.
    Mummy to two girls, 4 & 1, been at home for four years, struggling to contend with the terrifying thought of returning to work.

    listen up ok. dont bother just on my back bout what happened.

    Yes i missed a few payments with the CC company and they sold the debt to another DCA and i never got any contact from the company at all and they issued me a default. now that shouldnt be allowed unless they contact myself

    i think of my defaults and ccjs as a good thing. it stops you getting more credit and into deeper !!!! lol... think of it that way.

    You can indeed write to the DCA saying you didnot receive any notification of the default and asking them to remove it.

    You can of course also demand a signed copy of the original agreement, a statement of acccount and evidence that they own or manage the debt.

    If they dont provide suitable details etc you can complain to the OFT and Financial Ombudsman.

    However as you are reluctant to provide any real detail of your objectives and full situation its hard to say whether this will help you.

    If e.g. if you do actually still owe the debt and they do withdraw the default but then write to you properly saying they will default the debt unless you pay in full , then are you in a situation to pay in full... if not they will properly issue a new default and you are then worse off as you now have a new default that will take six years to drop off.
    Maybe this isn't the situation but a few more details might help people give some appropriate advice.

    What date does it say on your credit report that the account was defaulted? If it is quite a few years ago, like Clapton says, I would probably ignore it as they could issue a fresh one which will lead to another 6 years of default against you. If, say, it was issued 4 or 5 years ago then it is almost time for it to clear anyway.

    People aren't wanting to pry into your personal life, but the more details you are able to share about the circumstances of your debt and default, then the more accurate and detailed advice people can give you and hopefully the more helpful we can be.

  • The DCA weren't the company that would of given the default, the CC defaults you after failing to collect over a period of time in which you would of recieved letters and calls.

    You were then defaulted as last resort for the CC to claim some money back, the reason that you then recieved no reply is that you details are auctioned off to DCA so thats why you heard nothing for such a long period.

    There is no way that the default can be removed, apart from waiting for the 6yrs to pass until it drops off your credit file.

    wonkyfreg - what do you know? it was the DCA that gave the default as it says it on my credit report ok

    also it was in 2003 it was issued and the balance has been paid off now but i still want it removed. cheers for your advice guys
