Ukpc

Hey there, have been reading up quite a bit but have gotten to a point where I am too confused and not sure what to do.

I got a window ticket by upkc in July 2015... I chose to ignore as that was what I had heard and read to do with private companies.

In August 2015 I got two notices from UKPC with photographic proof demanding pay and I ignored.

I was abroad for a few months and in that time I got two letters (end of August and mid September) from debt recovery plus ltd demanding a I pay before legal proceedings, as I wasn't here I unintentionally ignored as I would have if anyway. I have just received a letter from a company called zenith saying it has now been passed to them and now they want me to pay them. Is this all a game ?? And I was on a residential complex at a friends house and I was in nobody's space or obstructing anybody

Many thanks

Mafeking has been relieved. I thought I should let you know as you seem to have been reading old and out of date information.

It has not been a good idea to ignore private parking tickets since the law changed in 2012 when the keeper became liable if the driver's identity was not known.

Luckily you are only dealing with UKPC who are currently being investigated for fraud. If it had been, say, Parking Eye you could be facing small claims court by now.

You need to read the Sticky thread for NEWBIES at the top of the main page here. This is your one stop shop for all private parking queries. Post 4 tells you what to do about debt collectors. Luckily for you they have no powers and can safely be ignored.

DRP and Zenith are the same company. Different desk, same building.

The basic advice is, do not pay, do not ignore, (too late now) do not reveal who was driving, never ever 'phone a parking company.

You should appeal anyway using the template in the NEWBIES thread. UKPC will tell you that you are too late to appeal, but you should point out that due to changes in EU law, you should have the opportunity to appeal up to a year after the alleged event.

  • Would continuing to ignore do me no good ?

Possibly. UKPC are being investigated for faking time stamps on photos. It is unlikely they would pursue anyone to court as they are most likely to be the defendants next time they appear there.

However, if you appeal and it ever got to court (very unlikely) you could at least prove to a judge you were being reasonable and happy to use alternative dispute resolution, but this was denied by the PPC.

It's up you - I would say it would do no harm to just ignore now. You were badly advised - or did old research, read very old stuff which is never a good plan - to ignore the PCN at the time as it would have been EASY to win at POPLA appeal.

BMPA advice is to ignore but keep the paperwork, which I would agree with.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
