ACPO PCN Birmingham airport - is there a timeline for notification for PCN?

    Can you please paste the final appeal draft letter. i had the same PCN and appeal reject by email with below reason-

    Please note that the above notice has been issued correctly due to the fact that this layby is strictly
    for hotel drop off’ s only. After viewing the CCTV footage it is clear that the passenger did not enter
    the hotel and proceeded to walk on. Therefore this is a breach of the terms and conditions for
    Birmingham Airport.

    but they failed to provide the CCTV footage evidence against the appeal response and simply mentioning ‘’passenger did not enter the hotel and proceeded to walk on’’. Even without mentioning the hotel name which they are referring as there are three hotels.

    any guidance how to reply this while making POPLA appeal.

    I love the contortions APCOA gets itself into over these airport cases.

    Some appeal points in addition to the usual ones:

    The driver of the vehicle cannot be held responsible for the actions of the passenger after the passenger left the vehicle. If APCOA believes the passenger has breached any Terms and Conditions let them pursue the passenger.

    In any case APCOA has not produced any evidence as to what the passenger did after leaving the vehicle. They have not produced any CCTV or witness evidence. There are three hotels in the "block" served by this drop-off point. Perhaps the passenger walked round the corner and entered the Novotel? Can APCOA prove that this did NOT happen? The sign at the drop-off point states "Hotel Drop-Off Only", it does not specify WHICH hotel.

    Of course, in future anyone wishing to use this drop-off point could ask their passenger to simply go into the IBIS hotel foyer and come out again 3 minutes later!
