Faulty Electrolux Fridge Freezer ENN2643AOW

We have this fridge freezer in our new build house from Taylor Wimpey. Since moving in on 29th June 2012 the fridge has broken three times, once a year. Each time the fault has related to the frost free nature of the item with the fridge either becoming too hot or too cold. Until now we have always had the repair free as it is a "faulty design" in the words of the engineers who have been out to us. Last week our fridge has broken again but on calling Electrolux customer service the repair is now payable by us. I appreciate we are out of warranty however a fault each year for a new product I don't find acceptable, all of the other AEG/Electrolux products have had no issue at all. I am now requesting from Electrolux, maybe what I should have done in the first place, a new product without this issue. I know we are not alone in this as a number of neighbours have already replaced their units and I can see from online forums this is a regular fault with this model. I have spoken to Electrolux Customer Service and now sent them an email requesting replacement of the item but is there anything else I can do? To buy a comparable new item is £750 which is why I have decided to try pushing the point with them rather than having it fixed yet again or buy a new one.

Did you buy from Electrolux ??
If not they are under no obligation to replace .
The vendor may be under SOGA but any refund/ replacement will be subject to a discount for usage as its 3 years + old .0 -

Why?
If they're wanting to charge for a repair, they're hardly going to just give you a replacement off hand are they? It sounds like they aren't even responsible from your initial post and may have just been repairing under standard warranty, which has now expired.
Your best bet here is SOGA, finding out who is actually responsible (I suspect Taylor Wimpey if it came with the house), getting an independent engineers report to state it is actually faulty by design or inherently faulty - then proceeding forward with a SOGA claim.
But please, don't email Electrolux Customer Service asking/demanding a replacement unit, if anything that's disproportunately costly to them and they're unlikely to do it - this just causes friction between yourself and customer services when they evidently say no.0 -

As the unit has failed 3 times in 3 years with what seems to be the same problem each time, this in itself may be proof enough of either an inherent fault or design fault. (although I realise that this would ultimately rest with a court to agree with)0 -
What is the recommended operating room temperature of the fridge/freezer? Is yours (and the neighbours) somewhere which goes outside this range during winter eg kitchen too cold?0
