Hi all,
Bank of Scotland have rejected two claims on 2 cards that I had.
BOS Findings
The sales to the cards ending ***** was made on a non contact basis. As such we were only required to provide you with information designed to ensure you could make an informed decision as to whether the policies met your personal requirements. It was then your choice whether to purchase the policies or not
summary of suitability findings
Exclusions
The information I hold about your circumstances when you bought the PPI Policies protecting your cards ending **** showed you were not significantly affected by any of the exclusions or limitations,
You were not suffering from any pre existing medical conditions which would have affected the ability to claim on your PPI policies protecting your cards ending ***
Here is the answer they gave,
"BOS Cancellation rights and Optionality concerns
I've considered all the evidence available to me, including the information that you have provided. I believe its more likely than not that the original nature of the policy was made clear to you in good time before the sale of your PP1 policies was concluded.
In particular, your Consumer Credit Agreement, which formed part of the sales process was provided to you, highlights the optional nature of the policies in a way which I believe to be clear, fair and not misleading."
sorry for this being longwinded, any point in contacting them again or going straight to the FOS, BOS did say in the letter to contact them if I still want happy
kindest regards Douglass

I would just move on.
A 'non contact basis' presumably means that you were not sold them as such.
You bought on the internet so therefore chose to buy it.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
I always thought for some reason to help the application the box would have to be ticked to get the card approved , also mentioned not advised the PPI was optional or advised re terms of cooling off period. suppose its my fault really, I did say I get 6 months full pay and 6 months half for any sickness.0

It comes across that you didn't read what you were signing?
You were not advised anything, this was a non contact sale. Had you read the paperwork any of your misunderstandings would have been clarified.0 -
I think, sometimes we have to accept that if we have made a mistake it is actually our own fault, rather than trying to blame somebody else for what, in the end, is our own folly.0

Was there anything in the paperwork/on-line that suggested for some reason to help the application the box would have to be ticked to get the card approved? If there wasn't you can't really blame BOS for what you mistakenly thought.
Where BOS have said "In particular, your Consumer Credit Agreement, which formed part of the sales process was provided to you, highlights the optional nature of the policies in a way which I believe to be clear, fair and not misleading." do you disagree with this claim?
Your cancellation rights should have been in the paperwork you were sent, are you saying it wasn't.
You need to be clear on what you believe BOS have done wrong when you forward your complaint to FOS0 -
thx to all, guess due to really being my own fault will let it go thx0
