Holiday Gems Cancellation

I had a holiday booked through holiday gems to Egypt. The flights were cancelled last Friday so I called them for a refund. They said they could not deal with it yet as they were dealing with people in order of travel date. I asked how much refund I would get back so I could look at another holiday and was told £1967.13 (£1747.13 original cost and £220 for a change of name)
Based on this my friend and I booked another holiday through a different tour operator. Holiday gems called today and said my refund would only be £1050 as they had already paid some of the suppliers. I said that I was told I would get a full refund so wasn't happy. They called my back later and said that they would give me a full refund but would withhold £97.17 which was atol protection and fees for paying online with debit card.
Reading the package holiday regulations, I don't think they can do this......... Does anyone know for sure??

  • Thanks but unfortunately it wasn't me who originally paid for the holiday so that's not an option.

    According to atoll if they are part of the global travel group ( they are) you should speak to them 0800 652 9808

    Then quite simply, you are not due any refund as you haven't paid anything.

    Armed with this new information, perhaps Unholyangel's response would've been:
    Get whoever paid for the holiday to speak to their bank about a chargeback.
