I was going through a ppi claims company. I have reclaimed years ago on my own, but thought I would use a company to have a final sweep. Anyway, they found a loan from years back where I was mis sold. And I was as I never ever wanted ppi for anything unless I was forced into. Anyway, the bank have contacted me, saying they will not deal with this company, but they will investigate the claim. They say unless I give a signed letter giving consent, they won't send any correspondence to the ppi company. So my question is, if they won't talk to the ppi company, and I get a refund, and the ppi company won't know. Do I have to pay them any money for fees.

    Yes you do. You entered into a contract.

    That maybe so. But. How will they know if the bank won't tell them and I won't give them permission. I am not bothered by ethics here.

  • 1) If they are investigating then that does not mean a missale has been made.

    2) If you are prepared to defraud somebody - even a scumbag ambulance chaser - then I'm out.

    I am not defrauding. There must be a reason the bank won't deal with them. If I get a refund, the ppi company cannot find out as my bank won't talk to them. I can choose to withhold that information. I am paying the ppi company do reclaim my money, if they cannot do that, as the bank won't talk to them, then they are not doing the service as per contract. Not defraud.

    Yes you are. Intentionally not paying someone that you entered into a contract with is fraud.

    Yes. Possibly they are on the bank's blacklist but that doesnt mean your contract is void.

    So the bank will send me a cheque. The ppi company won't know. So I should phone up said company, and say here is 40% of the money I got. Although the ppi company would never find out I got it. I should own up. Even though the ppi company couldn't close the deal.

    why not cancel your contract with them?
    Did you actually sign anything because if you had the company would have sent that to the bank to prove they could deal with them on your behalf....

    If the PPI company finds out, they can, and will, go all the way up to getting a CCJ against you for the money that you received as a result of their work which you signed a contract for. This will destroy your credit rating for 6 years

    You can try and cancel the contract and see what they bill you for their time, expect it to be a fair bit if they know of this loan, at least that way you would be free of the worry about the future bill.
