& im sorry if I didn't make it clear to other posters the situation. Partner 1 got IB and Partner 2 got SDA & income support top up. Couple got together & married and so claim had SDA, IB and IS top up. Then claim changed to ESA so partner 1 got ESA support group (contributions based) and partner 2 got ESA support group and there was still a income top up so the paperwork (which I've seen) comes in partner 2's name and says it's an income related claim with partner 1's contributions based ESA support group taken into account.
So as I now understand it, when they lose their income related eligibility, partner 1 will continue to get £109 ESA support group (contributions based) due to previously being on IB and partner 2's claim will become a contributions based claim due to them getting SDA up until they switched to ESA support group. Therefore partner 2 will also get £109 . All subject to no changes in their support group eligibility. DLA will remain in place as it is not means tested. Please correct me if I have misunderstood.

Yes they will both get separate contributions based esa.
