F1rst parking charge at university

    So why have they said that I was the driver?
    Because they want POPLA to think that was who the appeal was from! That lets them off showing keeper liability which they clearly don't understand. So, your job is to not let them off and tell POPLA how it really was: i.e. the appeal was from the keeper not the driver. You need to point out that the POFA still requires a NTK for keeper liability to apply, regardless of whether an appeal has been received from that keeper. A lack of NTK where the driver has not been identified (show your original appeal wording) is surely fatal to them holding you liable.

    Anyway, all your points you just typed out in the post before the above, are valid to state in your rebuttal which you will be emailing to POPLA this week. You have time, don't rush. As well as what you've already picked out (and I agree with all of it but be careful not to say 'doesn't mean it was that bright when I had parked there'!!) you need to pick up their complete lack of any effort whasoever to justify the charge.

    Have they not referred anywhere to ParkingEye v Beavis? Have they really only said 'our charge is based upon a GPEOL but we are not going to set that out at all'? Have they even provided a 'rough and ready' GPEOL? NOTHING to justify the sum?! You must seize on that, if so!

    Oh, and that sign doesn't show the £ of the parking charge clearly to me. Does it to you? Small print white on black isn't legible, can't see the £100 or whatever at all - ergo, the driver cannot have agreed to it because it wasn't stated on the permits or permit paperwork either was it?!!! And the photo doesn't show an expired permit clearly - or does it? From what you've shown us, their evidence is full of holes.

    POPLA have yet to make a decision yet F1rst have started sending me debt collector letters? I am so confused!

    let them get confused , confused as to the day they are expelled from the BPA!!!


    a nice email enclosing the debt collectors letters , whilst an ongoing POPLa appeal is taking place to the BPA should cause them grief

    +1 Never let them off with anything including claiming you were the driver. Also challenge the contract. It does not identify who at Lancaster that signed it and whether they had the authority to contract on behalf of the Uni. You need the full name and position of authority.
