Parcel2go.com compensation claim problems

Posted an item marked medical equipment through parcel2go.com. I had originally checked with Yodel on their prohibited items list and medical equipment was NOT on their list.
So I used Parcel2go.com to get a cheaper price using Yodel.
I paid £60 delivery for enhanced compensation insurance - their website accepted this payment.
The item was packaged well and fragile was written on all 6 sides of the box.
As you can probably guess the item arrived smashed to pieces.
Tried to make a claim only to be told that my item was on 'their' prohibited item list and so was carried without compensation even though I had paid £60 delivery for this service.
At no stage during the booking system did it flag up for me that the item might not be covered.
Surely this is fraud - how can you accept a payment for enhanced compensation insurance and then not honour it?
Surely the website should have refused my application for this insurance?
If you read their prohibited list, it is difficult to see anything that they will take.
County court summons has now been issued - waiting to see what happens.

  • If you book through a third party/agent then it is also their T&C you are restricted to.

    Let us know how this works out, but no doubt you ticked a box on P2G's site agreeing to their terms of business. I think your only hope is that they fail to respond to your claim and you win by default. If they offer a defence I think you may have paid another £25 for no benefit.

    How well was this item really packed? Fragile written around the box does not protect anything.

    I send glass bowls which I know I am going at my own risk. They are packed very defensively and I've only had one breakage in hundreds. That was my fault as I had doubts at the time as I was using a box that was too small to allow sufficient packaging to be sure it would arrive in one piece.
  • I'm no legal expert but surely they have a simple defence that it's excluded for the reason that it will most likely break and the customer chose to ignore this.

    OP contract is with Parcel To Go not Yodel. They may have a different agreement with Yodel so they can offer a cheaper price, than if you went with Yodel direct. Its frustrating but just goes to show that you should check terms and conditions before you agree to them.
